1. About the Service

Bedtime Stories by Luma ("the Service") is operated by a sole proprietor registered in Portugal ("we", "us", "our"). Contact: hello@bedtimestoriesbyluma.com

The Service allows users to create personalized children's stories and songs using AI-generated content, including scripts, illustrations, music, narration, and video.

2. Account & Eligibility

You must be at least 18 years old to create an account and use the Service. By creating an account, you confirm you are of legal age. The Service creates content for children but is operated by adults (parents, guardians, family members).

You are responsible for maintaining the security of your account credentials.

3. Credits & Payments

Story generation requires credits purchased through our payment system (powered by Stripe). All prices are listed in EUR and include applicable taxes.

• Credits are non-transferable and linked to your account.
• Credits do not expire.
• One credit is consumed when a story generation begins (at the script stage).
• If generation fails due to a technical error on our side, the credit will be automatically restored to your account.

4. Refund Policy

We offer refunds within 14 days of purchase if no credits have been used. If credits have been partially used, we may offer a partial refund at our discretion. To request a refund, contact us at hello@bedtimestoriesbyluma.com.

Under EU consumer protection law, you have the right to withdraw from a purchase within 14 days. However, by starting the generation process, you acknowledge that the digital content delivery has begun and the right of withdrawal may be limited.

5. AI-Generated Content

All stories, illustrations, music, and videos are generated by artificial intelligence (AI) systems. While we strive for high-quality, age-appropriate content:

• AI-generated content may occasionally contain imperfections or unexpected results.
• We do not guarantee that every generation will meet your specific expectations.
• Content is generated uniquely for each request and results may vary.
• We use content safety filters, but parents should review generated content before sharing with children.

6. Content Ownership & License

You retain ownership of any personal content you upload (photos, names, descriptions). For AI-generated content (stories, images, music, videos):

• You receive a personal, non-exclusive, worldwide license to use, share, and download your generated stories for personal and family use.
• You may share stories via the sharing link feature.
• Commercial redistribution or resale of generated content is not permitted without our written consent.
• We may use anonymized, non-identifiable data to improve our AI models and service quality.

7. Children's Privacy (COPPA & GDPR-K)

We take children's privacy extremely seriously:

• Uploaded children's photos are stored temporarily in encrypted, private storage during the generation process only.
• Photos are automatically deleted after story generation is complete.
• We do not collect personal data directly from children.
• The Service is operated by and for adults (parents/guardians) who create stories about their children.
• We comply with GDPR, including provisions for children's data protection.

8. Prohibited Use

You agree not to:

• Upload content that is illegal, harmful, or inappropriate.
• Use the Service to create content that is offensive, discriminatory, or harmful to children.
• Attempt to bypass security measures, rate limits, or credit requirements.
• Use automated tools to access the Service beyond normal usage.
• Upload photos of children without their parent/guardian's consent.

9. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or experience third-party service disruptions (AI providers, hosting, payment processing).

We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice.

10. Limitation of Liability

To the maximum extent permitted by law, our total liability for any claims arising from the use of the Service is limited to the amount you paid us in the 12 months preceding the claim.

We are not liable for indirect, incidental, or consequential damages.

11. Governing Law

These terms are governed by the laws of Portugal and the European Union. Any disputes shall be resolved in the competent courts of Portugal.

12. Changes to Terms

We may update these terms from time to time. We will notify registered users of significant changes via email. Continued use of the Service after changes constitutes acceptance of the updated terms.
